Federal Appeals Court Reinstates Inmate's Lawsuit

An excessive force lawsuit against the Phoenix Police Department is being reinstated.  A federal appeals court ruled Friday that a judge should not have thrown inmate Charles Byrd's lawsuit out.  

The 9th U.S. Circuit Court of Appeals ruled Byrd's claim that cops "beat the crap out of" him is not unconstitutionally vague.  

Byrd claims he lost 70 percent of his sight in the incident.
